I have provided the below timeline and chronology in regards to this traffic stop that the Waupaca County DA, Kat Turner, claims was “illegal”. Although there are several pieces to this case that may make this seem confusing, I am hoping that the below information will help you understand the TRUE facts just a little bit better. 4/23/2025 - I am notified by my Poynette Police Chief about the Brady notification memo that DA Turner had made reference an “illegal” traffic stop I had conducted back in July of 2023. I document everything into an “in the matter of” and forward it off. I also received an email from former DA Veronica Isherwood, who signed the criminal complaint for this case.

5/2/2025 - My Chief (not I) receives an email response back from DA Turner. It includes a total of eleven items that were either inaccurate, incorrect, or simply was her own opinion. My Chief and I find documentation that proves this to be true. I document it into an “in the matter of” and also save this documentation as “attachments”.
5/8/2025 - DA Turner still refuses to make the record accurate and rescind her Brady notification. So, Chief Duell and I meet in person with DA Turner and ADA Chuck Simono. ADA Simono is the one who originally brought this “illegal” stop to DA Turner. The meeting was a joke. DA Turner refused to accept any of the documentation that we provided her showing that she was incorrect/inaccurate and that the traffic stop was ultimately justified. DA Turner and ADA Simono ended up walking out of the meeting on us. I document this meeting into an “in the matter of”.
5/9/2025 - I sent a letter to all three Waupaca County Circuit Court Judges - informing them of this malfeasance. I wanted them to be aware that other cases are now in jeopardy because of DA Turner’s incompetence.

5/11/2025 - In our meeting with DA Turner and ADA Simono on 5/8/2025, DA Turner said she was able to obtain an email from State DRE Coordinator, Steve Krejci, stating that I had “nominated myself” for an award. When we provided a letter from Steve stating the opposite, she refused to show us her letter. She said she did not have it with her and it was on her computer. My Chief and I asked for a copy of it and she said that we could NOT get a copy of it. Since it is subject to open records, I filed a formal open record request for this letter that she claims she has.
It wasn’t until 5/27/2025, DA Turner responded with my open record request results. In reviewing these results, she had provided me with a letter from Steve Krejci that he had written on 12/27/2024. In this letter, no where does it say anything about me “nominating myself” for any type of an award. Therefore, I sent back another request, specifically asking for this letter that she claims she has from Steve that says I “nominated myself” for an award. As of 7/28/2025, I still have not received a copy of this letter.

5/12/2025 - In the meeting with DA Turner and ADA Simono on 5/8/2025, DA Turner said she had no reason to believe that the Sheriff’s Office dash cameras were off with their times. Well, I document two other cases that show that these older dash camera systems are actually off with their times. I document this in an “in the matter of”.
5/15/2025 - Based on the continued malfeasance from DA Turner and her refusal to make the record accurate, I filed a complaint through the Wisconsin Supreme Court - Officer of Lawyer Regulation. This complaint is currently pending at this time.

5/21/2025 - DA Turner still did not believe that the Sheriff’s Office dash cameras were off with their times. Therefore, I open recorded another Deputy’s OWI case during the same timeframe in 2023 to see if his camera times were accurate. I document these findings in an “in the matter of”.
5/28/2025 - DA Turner still refused to rescind her Brady notification so I filed an open record request with the Sheriff’s Office, comparing radio transmission times to Spillman CAD system times on the “illegal” traffic stop in question. I document these findings in an “in the matter of”. I also wrote a press release, since this was beginning to get media attention.

6/2/2025 - Since DA Turner was still refusing to provide me with a legally requested open record (the email from Steve Krejci) - I decided to file a petition for writ of mandamus. A writ of mandamus is a legal filing where I ask the court to review a potential open record law violation. If indeed the law was violated, the court can order the violator to release the record(s) in question. They can also order punitive damages. This was filed with the Waupaca County Clerk of Courts today.

6/2/2025 - I obtained official court records from the Waupaca County Clerk of Courts reference the felony OWI case against James Jacobs - where ADA Simono, on behalf of DA Turner, motioned to have the case dismissed back on the W23-12971 “illegal” traffic stop. Because of the DA’s Office malfeasance, this subject got to walk away free from any repercussions of and OWI (felony 4th offense!).

6/20/2025 - I was notified by the Wisconsin Attorney General’s Office that they would be representing DA Kat Turner in the Writ of Mandamus lawsuit.
7/1/2025 - Outagamie County District Attorney’s Office released a signed memorandum regarding an independent review of DA Turner’s Brady notification. In this memorandum, the Outagamie County DA found that they did not believe a Brady notification was necessary for Justin Malueg. Furthermore, they went into detail for each issue DA Turner had raised.

7/2/2025 - I forwarded the memorandum from the Outagamie County DA’s Office to DA Turner. I asked her to issue her own memorandum correcting the record in Waupaca County and I also asked for an apology. I received no response and haven’t been contacted by her to this date.
7/2/2025 - While corresponding with Sam from WBAY-Channel 2 in Green Bay via text, she informed me that DA Turner had provided her with a copy of my HR file without even being asked. She said “she had her assistant send it to me right after emailing them for the first time.” This is unreal - because if someone from the general public wants to open record my file, they have to file a request through Waupaca County HR. I have never seen, nor heard of a DA just sending it out to a citizen (without even being requested) before.

7/14/2025 - The Writ of Mandamus lawsuit has been stagnant, with no future court actions scheduled - so I decided to write a letter to the Honorable Judge Nielsen and request a court date for a hearing reference this matter.
7/17/2025 - The Honorable Judge Nielsen responded back with an official letter advising the respondent (and Attorney General’s Office) to respond back to the court with correspondence to get this case heard before the court. Judge Nielsen gave the respondent up until 7/30/2025 to provide a response.
7/30/2025 - The Attorney General’s Office filed a motion to dismiss based on several claims - including the argument that DA Turner had actually provided me with the letter from Steve Krejci. They argue that DA Turner “unartfully” used the wrong verbiage when she said I had “nominated myself”. DA Turner is essentially saying that she didn’t mean to say it that way. The problem is - we have her on an audio recording of her stating otherwise… and even calling Steve Krejci a liar. The motion hearing is set for 8/29/2025 at 1:30 PM.
8/29/2025 - The motion hearing that was filed on 7/30/2025 was addressed today by the Honorable Waupaca County Judge, Judge Troy Nielsen. It was determined that since both parties agree that there is no such record that exists (the email DA Turner stated she had), there is no action that can be taken today. Therefore, Judge Nielsen dismissed this Writ of Mandamus case.
With DA Turner agreeing that no such record exists - this shows that she had been dishonest when she met with my Poynette Police Chief and I. She stated a record existed when it didn’t actually exist.
8/29/2025 - Based on the previously reported information regarding the dishonest and disrespectful behavior of DA Kat Turner, we filed an ethics complaint through the Wisconsin Ethics Commission. We are hoping they hold her accountable and that it will prevent her from ever doing this to another community member again.
